Legal Question in Real Estate Law in California
Our neighbor has recently located 2 horses onto his property. This is in violation of our CC&R�s. Unfortunately the HOA has not been active since the 80�s. Can I as an individual have them enforced?

It depends on why your HOA is inactive and what the CC&R's say.

I disagree with Mr. Roach. CC&Rs;, if recorded, run with the land and give a private right of action to enforce them to the individual homeowners.
