Neighbors pepper tree is damaging our pool that is older than tree. How do we remedy situation if talking to them isn't working.?

I call this "trespass by tree," and the usual law of trespass applies. You may need to file suit and ask for money damages and an injunction. I would also suggest conferring with a trained arborist to confirm that it is the tree, to suggest ways to minimize your harm (maybe pruning the roots would help?) and to have a potential witness for trial.
