Legal Question in Real Estate Law in California

Neighbors Tree

Our neighbors large tree is growing right next to our cement block wall. It will eventually grow big enough to break down the wall, it is almost there. Also, it dumps leaves on our yard and into our swimming pool. What are our rights about this and how should it be handled.

Thank you,

Re: Neighbors Tree

The following is for general information purposes only and should not be construed as legal advice. It may or may not apply to your situation.

Your neighbors have no right to infringe upon your property line, and you should start by telling them to keep the tree and its branches off your property. In general, you may have the right to prune the tree back to the property line, provided that would not kill or harm the tree. But I suggest consulting with an attorney about your specific situation before you resort to self-help. (There's probably more to the story than you have said.)
