Legal Question in Real Estate Law in California

my neighbors washing machine drain hose popped out. the leak caused damage to my place. Because we are both insured, his insurance is not accepting liability ( due to a clause in the CC& R's) our companys are fighting it out. Meanwhile I am out $500 for the deductible. Can I sue my neighbor for this. The hose could have been secured to prevent this.

Yes, this is a technically-suitable matter to take to Small Claims Court, but I always suggest that in disputes between neighbors, that you try to negotiate a settlement before getting too antagonistic.
