Legal Question in Real Estate Law in California

non tenant eviction

How do I proceed in evicting an ancle from my aunts house. This auncle was allowed to stay for a month without paying rent and refuses to leave. My aunt owns the house and had to move out because of conflicts with my auncles wife. she gave them two weeks to move out, but they remained in the property and have no intentions of getting out. They are intending to borrow money from the house to finance theirs, without permision.

Re: non tenant eviction

The uncle has threatened to borrow money on your aunt's house, her problems may be greater than just getting the uncle and his wife out of her house.

The uncle can get a loan secured by the house only if his name has been put on the deed or he is involved in fraudulent activity, which probably involve forging the signature of your aunt.

Contact an attorney in the area where you live immediatlly. Provide the attorney with all of the facts. It may be necessary to file a legal action to protect the house.

You should act immediately.

To remove the uncle you would file an unlawful detaininer complaint. This can be complex, with many technical legal twists and turns. If you miss any of these technicalities the unlawful detaniner action will be dismissed.
