Legal Question in Real Estate Law in California
Number of Terms of a Director
What is the maximum length of time (years or terms) that a person
may serve on a Condominium board according to California Law if
any? Our CC&R's state that there is no term limit and it is limited
by the ability of a person to get enough votes every election and so
there is not a set number of years or terms that a person may
serve. One owner says that California Law and the legislature say
that you may only serve 4 consecutive years or terms then you
must take a year off. Is this the way our board should now be run,
(i.e. a person may serve for 4 consecutive terms or years and then
take at least 1 year off)? And if it is not done does it breech the
boards feduciary duty?

Re: Number of Terms of a Director
Never heard of such a law, couldn't find such a law by a quick (five minutes) on-line research session, nor has my associate who has served on a condominium board heard of such a law. Further, doesn't sound like something the legislature would impose....they dislike term limits!
