Legal Question in Real Estate Law in California
What are my odds of winning a lawsuit against the city when they approved a variance exception and use permit that will negatively impact my health, safety and well being? The proposal is my neighbors and was approved on appeal. The original denial was due to the fact that the Zoning Administrator could not find the proposal to NOT be detrimental to our health , safety and well being. The proposal went forward on appeal and had NOT been changed from the original proposal that was submitted. I am astounded that this same plan has now been approved. It will mean a 25 foot stucco wall will be 2.5 feet from my fence , for the entire duration of my backyard. Currently the abdoned home on the lot is 700 square feet, same as the rest of the houses on that side of the block. While we certaintly want the eyesore cleaned up we do not understand a variance exception of this magnitude. We plan to appeal to city council and if they uphold this proposal then I guess we need to sue the City? What should we do?
