Legal Question in Real Estate Law in California

what are my options; if i have a roommate that has people staying at our place for free for long periods of time saying it's none of my concern; making uncomfortable so i stay at my sister's and she expects me to pay half on all the bills; and so now i want to sublease my room out and now she is trying to send me to small claims court?

I'd guess that there are irreconcilable differences here, and you should end the roommate relationship as soon as your agreements with the roommate and/or the landlord permit. If you are sued in small claims, show up, bring favorable witnesses, and make your case to the judge. Maybe you could sublease to the long-term guest(s).
