Legal Question in Real Estate Law in California

If an owner is 90 plus days late with their HOA dues can we deactivate their garage door opener...they would still have free access to their unit...just not the garage. The parking spaces are deeded.

You can't engage in self help, and cutting off access to parking spaces will cause you to end up in a lawsuit and costing the HOA money in legal fees.

As Mr. McCormick states, the HOA has to follow the procedures in the Civil Code for enforcing HOA dues through liens. The HOA should speak to an attorney familiar in this area of law, before heading off blindly with a course of action that is going to get the HOA in trouble.
