Legal Question in Real Estate Law in California

New owner wanting to evict old tenant for own occupancy.

I just bought a 4-unit property in Los Angeles county where there is rent control or is covered by the rent stabilization ordinance. I want to evict one of the tenants so that my family could live on one of the units. How do I go about this? I read somewhere that I will have to pay the tenant a ''relocation assistance'' of $2K-$5K. Is this right? Is there a way that I could go around this I mean without paying for his relocation fee? Could I just serve him a 30-day notice alone? The tenant is on a month-to-month contract but has lived in the unit for 5 years.

You need to read the ordinance, and any caselaw that interprets it and if it is ripe for consitutional challenge. There is a constitutional protection against governmental taking without just compensation. You may contact me directly at (619) 222-3504.
