Legal Question in Real Estate Law in California
My parents own a home which my brother bought with their money when they sold their old home in California. He paid cash for the new homein California also. The Trust for the home is in their names and his also. He is living in their home and paying no mortgage. They are still alive and living with me in Idaho and they wish for him to either pay rent to them or sell the house outright. What do I (their oldest son) have to do to make this happen.. ? I do have DPOA. Please advise... Thank You...

A trustee who holds property in trust trumps a power of attorney. The acting trustee is the one who will have to act, and if he/ she refuses or is unable to act, will have to be removed.
