Partnerships

My girlfriend and I entered into a joint tenancy partnership on a house and now want to change it to a tenancy in common for our trust that we are going to set up. The mortgage company that we are with says we can do this on our own without them. Is this true or do they have to be part of the process. Thanks Mike

No, the lender need not get involved. All you need to do is deed it to each other (your signatures will need to be notarized on the deed) and record the deed. However, if you are preparing one trust with both of yourselves as beneficiaries of the trust, you may want to deed it to the trust.
