Party A sells a restaurant that he closed for several years to Party B. Party after buying the place finds Party A old recipes book. Party A wants them back. Party A sues Party B to get recipes back..

2. Party A not prevail because the sale of the restaurant includes everything in tit.

Sounds like a law-school hypothetical. We don't do those. Actually, if the restaurant closed while A was using those recipes, I'd say they are worthless anyway.
