Legal Question in Real Estate Law in California
Perjury in a Declaration
I had incoming cell phone calls from a person on 07/18, 07/20, 07/22, 07/23 at 8:34 AM, 7/23 at 10:51 AM, 7/23 at 11:52 AM, 7/24, 7/25, 7/26 at 9:55 AM and 7/26 at 7:06 PM. This person received a Conditional Salesperson License on April 10th, 2007, with only one course and requires supervision from a broker. The designated broker had disappeared and we did not know where she was. I received harassing calls about the a lockkey which I did not have. Finally, I asked this person not to call me again and I have not spoken to her since July. This person filed a declaration saying I said the designated broker was conducting criminal activity.
I would never use the terminology – is conducting criminal activity. I might believe something is illegal but I am not qualified to make the determination that it is criminal. That is the responsibility of the appropriate authorities. This person committed perjury.

Re: Perjury in a Declaration
Possibly the person committed perjury. You said nothing about the contect in which the supposed declaration was filed. Filed with whom? For what purpose? Part of a lawsuit? Who cares? What's the question?
