Legal Question in Real Estate Law in California

do i need personal insurance?

If an unhappy client is threatening to sue my company and myself for misconduct- whatever that means, will I be completely covered by my company's E&O insurance or do I have to defend myself? I am a w-2 employee.

Re: do i need personal insurance?

This question has been asked and answered at least once. The answer involves guesswork about whether you were acting in the course and scope of your employment at the time of the alleged misconduct, or whether you were off on a personal errand, so to speak. You should find out from the employer and the insurer as soon as possible. Only they can tell you what they're going to do. If they refuse coverage, you might speak with an employment lor insurance law specialist to see whether you have a right to demand coverage, but that determination will require full disclosure of the facts of the misconduct alleged.
