Legal Question in Real Estate Law in California

Personal Property thrown out by Apartment Manager/Staff

On October 1, 2002 I gave my 30-day notice to move out of my apartment. I rented a refrigerator from a rental company, and I called to have them pick up the fridge to move it to my new apartment. They were busy and were closed on Halloween, so they couldn't move the fridge until Nov. 1st. Yesterday I returned to the apartment complex to surrender my keys. On my way to the office I passed by my old apartment and noticed they were already inside the apartment, renovating. I saw that the fridge wasn't there, and I knew that the rental company wasn't able to move it until the afternoon. 3 days prior, I warned the manager that the fridge would not be moved until the afternoon of the 1st. I asked one of the maintenance men inside my old apartment what happened to the fridge; he said they'd thrown it away and it'd already been taken by the garbage men. After talking to him and a second maintance man to confirm the story, I went to the office and asked the manager what had happened. She said that she not only had no knowledge of what had happened to the fridge, but she could not recall ever speaking to me about the fridge being picked up on that date. I then returned the apartment keys to her and left the premises.

Sue them. There are rules to be followed regarding "abandoned" property, even if you had not told her. She is responsible.
