Legal Question in Real Estate Law in California

Pigeons

We have a neighbor feeding the pigeons. This is causing them to roost above the only outside place to park our vehicles. As you can imagine, 20-30 pigeons do not leave small messes. We have repeatedly asked her to stop feeding the birds. We have asked her son to stop her from feeding the birds. The apartment complex we live in has put a ban on washing our cars in the shared driveway. In this area, as I understand it, feeding a canine or feline for 14 days consecuatively makes it yours, and all legal obligations yours. Is there any such law about birds? If not is there any thing else, short of moving, that we can do? Washing our cars every 3 days to keep them clean enough to see out the windows, is more expensive than we can afford. Keep in mind we are told, in our lease, not to wash our cars in our driveway.

Your neighbors are creating a nuisance. "Nuisance" is not just an apt description, it is a legal term of art. You could sue

them and ask the Court to order them to stop feeding

the pigeons. Unfortunately, you can't get an

injunction in small claims court, so you'll need a

lawyer.
