Legal Question in Real Estate Law in California
The place I am looking to rent is asking for first and last month's rent plus a deposit. Can they require me to prepay the last month's rent? This is in California.

Yes they can, although it is considered to be a form of deposit, and therefore counts as part of the 2x rent maximum deposit amount allowed by law. So as long as the regular deposit plus the last month's rent deposit does not total more than 2x the monthly rent, it is legal.

I agree with Mr. McCormick, although the legal limits vary depending on whether the apartment is furnished or unfurnished and whether or not you intend to have a water bed.
