Normally when an unlawful detainer is filed a court date is also given. Check the court's web site to see what is going on. If the landlord has followed all the court local rules, there is no basis to dismiss the unlawful detainer. If the landlord is supposed to request a court date and has not, yuou could ask that the matter be dismissed but probably the court will just reset the case for another status conference to let him get a court date and dismiss the case at the next SC if no court date has been set.
