precidure of termination to month to month rent agreement

i have a tenant on a month to month rent agreement(not rent control) that i want to terminate, she hasent payed her rent,what is the right way to go about it? , how long would it take if she dosent want to leave?

a 3 day notice is served. If no payment, an unlawful detainer is filed. Generally it takes 3 weeks to 4 weeks if there is a default and 6 to 8 weeks if it is contested. There are exceptions

Serve a 3 day notice to pay rent or quit. If they pay then serve them with a 30 day notice (if you want them out). After the time expires file and have them served with an Unlawful Detainer Complaint.

If the tenant has not paid rent, you need to serve her with a "3-Day Pay or Quit" notice. If she doesn't pay in 3 days, you can file an "Unlawful Detainer" action.

Depending on whether or not she answers the complaint, she can be evicted in 20-25 days.
