Legal Question in Real Estate Law in California
Predatory Lending Victim led to forclosureTT
Two years ago I was sick, divorced and on disability.House I have owned for 28 years was forclosing.I decided to put my house up for sale.My realitor convinced me I should refinance, pull my equity out to live off of and then sell. She had the house appraised for 799,000.00.I owed 350,000.00.So she told me I had over 400,000.00 in equity. I ended up with a 3,776.00 house payment on my 900.00 dollar a month dissability.I tried to find her to sell the house and she was no where to be found.I recieved a 100,000.00 check that was supposed to carry me over for the next year.Con artists swindled my money while I was sick. Caregivers, gardners, bookeepers, I was burglarized and robbed.Money was gone I was in hospital for surgery.Hard money lender came to me in hospital and lent me 50,000.00. I caught up bills and continued to try to sell 8 months later I had a buyer, I lowered the house to 500,000.00.3X escros later the second went into forclosure and one of my offers bought the second and put the house in his name.He broke into the home three times and smashed up my kitchen so it was uninhabitable and unsellable. He was arrested.I was waiting for a police report & he won by default. Still fight for my home? Legally what to do? Help!

Re: Predatory Lending Victim led to forclosureTT
It sounds as though you did all this to yourself; being sick is not an excuse for being irresponsible and no one can cause you to get a loan on property if you don't want to--all you have to do is not sign for the loan--it is not the realtor's fault if you made bad decisions, as presumably you are an adult. Then, after getting money out of your home, you say someone "swindled" it out of you, and then you were robbed and then you allowed someone who was "arrested" to get off on a "default?" You are the one responsible for your situation, no one else, and you should accept that and stop making excuses and blaming others.
