Legal Question in Real Estate Law in California
I had previously posted a question in regards to a property I had sold on a lease option to buy. My situation was that the two parties that purchased the property are invovled with a civil suit with each other cause they are no longer business partners. The property is all paid off but the title company will not release the funds due to the civil suit. Even though they had released a portion of the money prior to the property being paid off and the civil suit. Anyways my new question is what is the best way to go about getting an unstuck escrow. The property is in san bernadino county is that the county I should file with. Also the property is owned by 5 other people and we all are having economic problems so what is the best way to get a lawyer and about how much would the fees be. Thanks for your time

You have a very complicated problem. I spent over half a decade in-house with the parent company of numerous title and escrow companies comprising the largest market share in the title and escrow industry. Without reviewing the escrow documents, your lease option documentation, and the lawsuit, I can assure you that there are several ways that COULD be used to free up the funds, but I can't begin to guess which would be appropriate and effective. The county where the property is located is PROBABLY the correct forum, but if the escrow is in another county, or target defendants (once who should be sued is determined) live elsewhere, then it may not be the correct county.
