Property Easments

How can I get rid of a property easment.

The home I would like to purchase has a drive way that the neighbors would use to access their homes when the properties were first built. Back then there was no access street for the neighbors to reach their homes, now there is an access street and the neighbors have walled off the old access drive way leaving only a walk through gate. The easment is for 10 feet so this easment has been been altered.

There are eight or ten ways to terminate easements, many of which work in only certain situations. In your case, mutual agreement seems to be the best possibility since not all the conditions for termination by abandonment seem to be present.

Terminating an easement and documenting and recording it properly is rather technical and you should obtain the services of a lawyer experienced in real estate matters in your county.
