Legal Question in Real Estate Law in California

I have a property that is rented. My renters hit a tree with their uhaul truck. They damaged the tree and caused debris to block the road. The HOA is now holding me responsible for the cost of repair and clean-up. The accident was reported to the police. Am I liable? Also if I am can I use monies from their security deposit to pay for their motor vehicle accident?

As between the HOA and you, you are liable. You are entitled to bill your tenants for the loss, though, if they caused it. If they fail to pay, you can deduct it from their deposit.
