Legal Question in Real Estate Law in California
Property Rights and Forced Eviction
Hi, In 2004, my friend took his sister's advice and bought a ten acre parcel with a home on it as well as a granny flat (second dwelling.) His sister then talked him into selling her 50 % interest in the property as joint tenants. She was always shuffling papers infront of him for signitures, telling him to trust her that she would take care of everything. Some research has shown that she and her boyfriend are now sole title holders. She has since demanded that he vacate ''her property'', cut both power and water to his unit as both unit ran on one shared meter. She has basically defrauded him of his property. Yet she still sends letters requesting ''his'' half of the property tax, property insurance, etc. Does he have any recorse to fight for what is his? Is it illegal for her to cut power and water to his unit on a weeks notice? Can she be held responsible for damages by defrauding him, cutting utilities etc. He has no where else to go and limited funds for legal council. Isn't there anything we can do quickly to at least have basic running water, and electricity immediately pending a probable delay in any resolution? She has no response to his attempts to talk to her. Won't even accept certified mail sent to her by him. Help!
