Regarding property tax unpaid by 1/2 owner

I own 1/2 of a parcel of land.I have to pay the property tax on my half as well as my step brothers half.He cannot pay his share,so how can I put a lien or judgement against his half of the property,this is just bare land. Is there a way to obtain his share due to his unpaid share of taxes.

Get him to sign a note and deed of trust, which can be recorded against the property. If he won't do it, the only way is to sue him and get a judgment you can record. If this is too much hassle, simply keep good records and charge it against his interest when you sell.

You cannot put a lien. What you can do is file an action to partition or sell the property. While you may not want to sell, your "partner" may then pay in order to avoid the sale. Should you want consultation, please contact our office at 714 363 0220.
