Legal Question in Real Estate Law in California
I own have property for over 30 years in a subdivision with a mandatory membership in a Road Maintenance Assn. The problem is that the Assn has seen fit to chip seal the main road and a portion of another but the members wont approve the funds to chip seal the remainder of the roads even though we all pay the same annual road maintenance fees. There is approximately 3.2 miles of chip sealed roads and about 1.2 miles of gravel road. Is there any recourse to force the assn. to finish chip sealing these roads.
1 Answer from Attorneys
Possibly, but the answer is going to turn on a number of factors and details about the association, the governing documents, the governing members and their properties, and a whole lot of details about how and why the decision was made regarding the chip sealing. You are going to have to talk to a lawyer directly to get any kind of realistic answer as to what may or may not be recourse available to you.
