Legal Question in Real Estate Law in California

My question if a home is jointly owned (California), are both parties required to give their permission to rent out the house. My spouse is currently renting the house out without my permission.

Both spouses must consent and join in executing any instrument by which community real property or their interest in community real property is leased for a period longer than one year. (Fam. Code, � 1102.)
