Legal Question in Real Estate Law in California

question

Hello, I am a Realtor here in San Diego,CA. I have a client who lives in Canada and that is whare there primary residence is. They are looking to buy property here in San Diego,CA. Since they are frequaint visitors. Is this possible for them to own property here, within CA. law? Or what might they have to do?

There are no restrictions on a Canadian citizen buying property in California. Just complete the CAR form like you would for any other buyer. There may be tax issues and withholding requirements when your client later goes to sell the property, but it won't affect his ownership of the property.

I had a foreign client who did not want to establish residency in the U.S., so we formed a California corporation to own the property. That may be desirable depending on your client's tax status, but is not required. Holding the property in a California entity will make it easier when it comes time to sell it.
