Questions on Eviction and Unlawful Detainer.

Just recieved an Unlawful detainer paper, would like general laws and what to do first. Suggestions on how to win. We are 20 days late on the rent and made a verbal agreement to pay rent late.

First you need to file an answer to the complaint with the court and i think you only have 5 days to do that so you better hurry. The court clerk will sell you the form. Tell them you need a form answer to an unlawful detainer. When you go to court, bring any witnesses who have knowledge of the agreement.

You have only 5 calendar days in which to file an answer. The only exception is if the 5th day falls on a Saturday, Sunday or legal holiday. Then you have until the next court day.

After filing your answer, you should go to the county law library and read the Eviction Defense Manual, or other such book. Nolo Press may publish a book on eviction defenses. Nolo books are generally very well written and provide information that can be used in court.
