Legal Question in Real Estate Law in California
I am getting ready to rent out a property that sits on an arterial (very heavy traffic) roadway. There is considerable noise and a lot of diesel smoke. Do I have to disclose the potential health affects to a tenant?

Probably, but extol the virtues of your double-pane noise-resistant windows, and that the bedrooms face the rear! The noise and smoke would be apparent to anyone considering the property, though.

Traditionally, it was considered unnecessary to "disclose" the obvious -- but in an era of litigation and whining complainers, it's probably a good idea to point out these facts.
