Legal Question in Real Estate Law in California

Real Estate Advice

I have an agreement with a partner to pay for half of all cost on a realestate property including the mortagage and taxes. The taxes came due and he does not have the money on his behalf to help me pay for them. Does this void our contract and what do i do now. I have since payed the taxes, but he still has not given me his half. Help Please.

Re: Real Estate Advice

What contract? Did you yourself hire an attorney to draft this contract? Your question should be completely answerable by reading the contract. Get out of the "partnership" (that is to say, take formal steps to dissolve the partnership the right way before you become liable for some other action he takes). Sue for what is owed you.

Re: Real Estate Advice

the language in the contract will dictate your/your partner's rights and/or obligations therein, as well as whether or not your partner's breach of contract is deemed material or minor. Contact our Law Firm directly for further advice on how to handle this legal situation best.
