Legal Question in Real Estate Law in California

real estate code compliance

Seven years ago I bought a house with a VA Loan. I also paid for a title policy. Last week the city code inspector said that I had to bring the room under code compliance or remove the room. He fined me $114 and gave me 30 days to respond. As near as I can tell the room was built 8 years before I bought the house. Can the city do this to me and what recource do I have, if any, with the title policy?

Re: real estate code compliance

The City has absolute authority to control and regulate zoning within their community so the city can make you bring your residence into compliance with the rest of the community. Depending on the city in which you live you may be able to apply for various remedies like a variance. If your title policy covered building permit violations from previous owners then you will have recourse against the Title company.

You should have a lawyer review your policy ASAP.
