What is the process for a non-judicial foreclosure in the state of California?

The foreclosure process is complex, in that there are numerous reqirements that must be complied with, or the process is not valid. If you are the party that is foreclosing, you should consider hiring a professional foreclosure company to do the foreclosure. If it is your property that is being forclosed on you need to consult with an attorney.

Basically a notice of default is recorded and notice of the reocrding of the notice of default is served on the person whose home is being foreclosed. During the 90 days following the notice of default was recorded the borrower can resinstate by paying the past due payments and the costs of foreclosure program. After the 90 days have run then notice of the foreclosure sale is published for 21 days. The property is then sold at a public auction.
