I currently have a mortgage with my brother, he has refuse to pay any share of the mortgage payments thusfar. Do I have any legal recourse

Yes, you have legal recourses. If this is a temporary situation you could sue him for contribution, etc. of his share of the mortgage payments. If it is going to be a long term problem you may have to sue him for partition to sell the property. Otherwise you may end up losing the property if he won't regularly perform his obligations.
