Legal Question in Real Estate Law in California

Real Estate - Senior or Junior Lien?

I obtained a Judgment on a person before they had any real property. I recorded it at the county recorders office. I have kept up the ''renewal Judgments'' before due date for the renewals. The people then purchased a couple pieces of real estate. Is my Judgment Lien Senior to any Mortgages they may have on these real properties?

Re: Real Estate - Senior or Junior Lien?

Your lien is junior to the purchase money security interest, other than that, looks like you did everything right.

Your judgment is second only the mortgages used to purchase the property. See Civ.C. 2898
