Real Estate Woes
I live in California and I recently received a letter from HUD that I am eligible for a Mortgage Insurance Premium Refund for a house that I purchased in 2000. It just happens that I filed for bankruptcy in 2002 due to criminal proceedings I was faced with. I no longer own the house but found out that someone tried to take over the house and for four years made payments on the house and paid it off under my name. I did not sign over the deed and was very unaware that my name was still on the deed. Do I have any legal action against the party that has that deed.

Since bankruptcy does not automatically result in the loss of the residence, I do not know why you feel you no longer own the home. Someone must own it. If you do not own it, what damages have you suffered from someone doing something to a house you have no title to nor interest in? You might be able to get the money from HUD up to the date you gave up ownership, but you must find out from HUD what their rules are. You also need to check as to whether you did lose ownership.

You might go to the county recorder's office and review all of the deeds for the property. Go over them to see the chain of title. Or, you might have a friend who's in real estate do it for you. You might still own the house. That could be a pleasant surprise. Bring all the paperwork to a real estate lawyer to evaluate.
