my family recently had a lien attached to our home, without knowing we were in the process of selling our home the sell of the home was and the potential buyers sued use due to negligence. our attorney has been working this case and we are not getting any information on the case and it's been going on for a long time. what rights due we have in regards to a time frame on we the case should settled document information that this firm is working on our case, he never returns our phone calls and we have trouble contacting him. Our last court date the judge told him he was lazy and agressive qand gave him a date of 30 days but the date has gone by a we still have not heard anything. please help!

It sounds as though you are asking a group of attorneys whether or not your attorney is handling your case properly, without those attorneys knowing anything about your case, or your attorney.

This is a difficult and awkward question to answer. It is a tort in California for an attorney to lure another attorney's client away from him. It is called tortious interference in a contractual relationship. With that said, it happens all the time, and there are many attorneys in this state who have grown fat off of the sweat of other attorneys.

If your attorney is not returning your calls, and you are not one of those clients who calls 5 times a day, (we do have other matters, from time to time) you may have to contact the California State Bar, regarding abandonment of your case.

If your attorney does screw up your case, you do have the option of filing a malpractice action against them.
