Legal Question in Real Estate Law in California
Didn't this real-estate agent mislead us?
In 1995 we had decided to buy a house. I found this house and liked it. The real estate agent ran our credit check and said that because of the bankruptcy we would not be able to purchase. That was the end I thought. The owner of the house(the agent's nephew) had a open house, I had not planned to attend but the agent called me around 3 in the afternoon and said that she(the agent) had a "friend" that could possibly help me get financed so maybe I should come and talk to the owner and make a offer. I did. We moved in with a first and last and security deposit and the friend said he could get us financed. Well a couple of months rocked on and the friend decided he could not but had a way after all. He told the agent about a CAL-EQUITY PACTrust, she in turn told us about it. We did that. We put in $20,000.00 and was told the house was ours. Well the owner trustee did not make the pay, ments we sent in and the house is foreclosed, we have to move out and we are out our money.

If I were in your position I would contact the California Department of Real Estate, and the district attorney's office in the county where this occurred. A complaint would be filed with both of these agencies.
Contact an attorney regarding this matter. It appears from what facts that you have given that the individuals chaeated you and took you money under false pretenses.
