Legal Question in Real Estate Law in California

Refinancing my home, without spouse info....

I originally bought my home alone, only my name on the title. I have since gotten married and would like to refinance my home. Can I refinance my home alone as well? I am the only one employed, and the only one with decent credit. In fact, his credit would probably prevent us from getting a loan. I wish to remain solely responsible for such property and he doesn't want to be on the title or be responsible for such either.

Yes, you can refinance with your info only and with your name only on the deed. Normall "Mary Smith, a married woman, as her sole and separate property".

One thing you need to remember is that, unless you have a more formal written agreement to the contrary, your income is considered community property. Any reduction in dept would give the community an interest in the property, even if only your name is on title.
