Legal Question in Real Estate Law in California

Removing a boundary fence

We have a fence that separates us from our neighbors, it is inside our property line. It is need of replacement and I have been asking the property owner of the house next door to help in the costs. She refuses. This has been going on for a few years. Now the fence is falling down and really needs to be removed. Can I remove the fence and just not replace it? Or put up chicken wire? I do not want to pay the full cost of the fence only to have her reap the benefits.

Re: Removing a boundary fence

There is a statute that states that adjoining neighbors must share the costs of a common fence. I will look for it and post another response for you.
