What you are asking is very simple but is much more complicated than you imagine. It first depends upon in what form the title is held. There are many more tax effects than you can imagine from taking your deceased spouse off of title. Some may need a summary probate proceeding and others avoid probate. The effect upon you though Will possibly be significant in terms of how much taxes you would have to pay when you sell the property in the future. Therefore, my advice to would-be get an attorney who is expertise in Real Estate law/probate we should be able to very quickly when you give him/her the proper information to you whether or not you wish to take the easiest or other method.
