Legal Question in Real Estate Law in California

later rent fee for wrong date

My apartment complex returned this months check to me because i had accidently put January 2005 instead of January 2006 for the date. Now they are charging me a $75 late fee. Is this really legal?

Re: later rent fee for wrong date

It is not fair of them to charge you a late fee. You tendered payment, although the date on the check was wrong. But the wrong date does not mean the check was invalid. The check could have been cashed. I would oppose the late charge. Good luck.
