rent

I just want to know if my landlord has to lower my rent. Our lease expired in December they never notied

me or asked if I would like to renew. I came to realize they have lowered the rent by $100.00 a month.

Howdy:

When a written lease for a term expires, it converts to a month-to-month on the same terms. The landlord can raise the rent provided you're given notice required by law or the lease.

If your lease converted to month-to-month and the landlord lowered your rent, you're fortunate.

If your lease converted, and new tenants are paying less, there's no obiligation to adjust your rent. Each lease is a separate negotiation.

Did they lower your rent by $100.00 per month? Or did they lower the rent of the new tenants by $100.00 per month? If they lowered your rent inadvertently. And the lease automatically renewed on the same terms and conditions for a month to month tenancy. You could end up owing them money ($100.00 x ? months) when they realize they made a mistake.

I an assuming that you mean that they lowered the rent for new tenants by $100. No, thye do not need to reduce your rent. Chances are that the lease says that the rent will automatically convert to a month-to-month under the same terms.

If you want them to lower the rent, you will need to go talk to them. If they don't lower the rent, accept it or give 30 days notice ... then try to renegotiate.
