Legal Question in Real Estate Law in California

Ex wants to rent out a room in a condo we own..

ex and i purchased a condo in 2003

(Joint Tenants). my ex left in

february of this year moving to

another city and has not made any

housing payments of any kind (i have

asked many times and have been

turned down). it has been on the

market for 6 months with no bites...

even after lowering the price 50K. i

have kept up on all housing costs but

have now exhausted my savings and

sold as much of my personal property

as possible. i can continue to pay my

half of the housing costs, but i

cannot afford to pay my ex's any

longer and my ex wants half of the

equity upon it being sold. i just told

my ex that i will not allow for any

more showings until my ex resumes

making payments and reimbursing

me for the missed payments. i just

saw an ad on craigs list where my ex

listed a room for rent in our condo

where i live, put an ad selling my

couch and love seat (i have in writing

my ex gave me the furniture in

exchange for a some property my ex

gets to keep). Can my ex legally rent

a room to someone in our condo

without my consent? and can my ex

sell furniture given to me?... can i

change to locks to prevent this from

happening? help anyone?

Re: Ex wants to rent out a room in a condo we own..

You should file a motion requesting that he pay one half of the mortgage. Further that he is not list any of the rooms for rent or the sale of any furniture without your written consent. It appears that you aree living in the house. If that is the case, having strangers come to the house regarding the room for rent could pose a significant danger to you. If he is living in the house then he should be paying the entire mortgage, unless he is financially unable to do so. Also you should have an attorney representing you, and you should be discussing this with your attorney not seeking information over the internet.
