Legal Question in Real Estate Law in California

No rental agreement

My dad let a family stay at his house for a while, no rental agreement, he asked for a small amount of money per month. She paid my dad some money, but refuses to pay any more. My dad is on a fixed income and with the additional cost of utilities and money missing, is having trouble meeting his finacial obligations. He had a head injury seveal years ago, long story short, I am somewhat responsible for him. The woman and her family are harrassing my father and taking advantage of him, he had his ATM card stolen by the womans brother. Bad situation all around, my Dad asked her to move out, she called me and said she knew her legal rights and would not move out without an eviction notice. Help.

This probably does call for a formal eviction and one possibility is to use a professional eviction service or at least talk to one.

You might also talk to legal aid in your county and/or find out if there is an organization devoted to prevention of "elder abuse" and seek their advice and help. You might need a restraining order or other tools to accomplish what needs to be done without further financial or physical harm occurring.

An unlawful detainer action will get them out. Act quickly as there is something called adverse possesion which allows title to pass to squatters after seven years. Please call me directly at (619) 222-3504.
