Rental question????

I was wondering if it is legal for a landlord to give a tenant a 30-day notice because the place is being sold and the new owners want to move in asap?? And then once were out, the owners really didn't move in, but upped the rent and re rented it to someone else???

First, do you have a lease?

Second, are you covered by Section 8 or some form of rent control?

If either of your answers is 'yes,' the landlord must give a valid reason for asking you to move. Sale of the property is a valid reason.

However, if you are a rent controlled or public assistance tenant, if the landlord said he was going to sell and then didn't, you may bring a suit for damages, and possibly reclaim your home. If that's the case, you should consult with an attorney.

Generally, an owner of real property in California may give a tenant on a month to month tenancy a 30-day notice to quit for any reason, or no reason. The fact that you were told that the property was being sold, probably would have no affect on your obligation to move.
