Legal Question in Real Estate Law in California

Rentback Damage

I recently purchased a home in CA whereI agreed to rentback the property to the previous owners, When they moved out, they caused water damage to the property. Their moving company is evaluating the damage and possibly compensating me to fix the damage. I would never have purchased the property with this damage and I will have to disclose this to the next buyer. While I can sue for the damage, can I sue for the lowering of my property value as well as the time and expense I have taken to fix this problem.

Thanks.

Re: Rentback Damage

You can sue for all damages proximately caused by their actions; such would include the lowered value to the property that can be proven.
