Legal Question in Real Estate Law in California

Renters Rights following an apartment complex fire

Following a fire at our apartment complex (caused by another tenant), our manager assured us that in addition to repairing the holes in our roof and ceiling caused by the firemen, that the apartment owners would reimburse us for any expenses due to smoke damage (cleaning bills, hotel stay, etc). I turned in my receipts on the first of the following month and asked if she would take that in lieu of rent. She did not reply for almost 3 weeks, at which time she left me a letter with my origianl receipts, stating my rent was still due and that if I wanted reimbursement, I would have to contact my own insurance person. I do not have renters insurance. I am not sure if I want to pay rent at this time, but she has given me a "pay in 3 days or quit" notice. Please advise.

Re: Renters Rights following an apartment complex fire

You should pay the missing rent within the three-day

period to protect yourself against eviction. Then sue

your landlord and whoever was at fault for the fire

in small claims court.
