Legal Question in Real Estate Law in California
Replacement of carpet??
My carpet was not new when I moved in, I have been living in the apartment since 12/00. I am going to have the carpet cleaned, what if the landlord deams it necessary to replace the carpet. Who would be responsible for the new carpet?? Also, we hung pictures on the walls, I asked the landlord if I could get the paint spec. so that I could patch all the holes and paint over them, they said it is a ''custom'' paint that only they can get. To me, this is their way of charging me inaccurately or obsessivly for the repairs that I could make myself. Is this legal? How can I make the apartment look the same as when I came in if I can't paint? What is considered normal ''wear-and-tear''? Thanks.

Re: Replacement of carpet??
Unless you damaged the carpet, such as cigarette burns or stains that could not come out, cleaning of the carpet should be adequate. A landlord cannot charge you for replacing a carpet, absent some physical damage. Walking on a carpet, causing it to wear out, is normal wear and tear.
As far as the paint is concerned, go to a paint store, either with a small chip of paint and have them match it, or get the little paint sample strips there, and match them to the walls. Carefully patch the holes and repaint those areas.
Chances are, they are not "custom". Landlords typically go the cheapest way when painting.
Good luck.
